Terms of service
General Terms and Conditions
This is a translation for your convenience. The German version is legally binding.
§ 1 Scope and provider
(1) These General Terms and Conditions (GTC) apply to all orders placed via our online shop at https://pokeprinz.de. The provider and your contractual partner is:
Philipp Hartmann – PokéPrinz
Dürener Str. 118
50931 Köln, Germany
Email: info@pokeprinz.de
Further details can be found in our legal notice.
(2) The version of these GTC valid at the time of your order applies. We do not accept deviating terms of the customer unless we expressly agree to their validity.
(3) We sell trading cards and trading card products (including Pokémon, One Piece and other trading card games), accessories and merchandise.
(4) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity.
§ 2 Conclusion of the contract
(1) The contract language is German.
(2) We deliver to Germany, the member states of the European Union and the other countries available for selection during checkout.
(3) Customers must be of legal age. Minors may only order with the involvement of a parent or legal guardian.
(4) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
(5) By clicking the order button (e.g. “Pay now”) in the last step of the ordering process, you submit a binding offer to purchase the goods in your shopping cart.
(6) After submitting your order, you will receive an automatic order confirmation by email. This only confirms receipt of your order and does not yet constitute acceptance. The purchase contract is concluded when we accept your order by sending a shipping confirmation by email or by shipping the goods, whichever occurs first.
(7) We reserve the right not to accept orders for quantities exceeding normal household requirements or orders recognisably intended for commercial resale. This also applies to several orders of the same product which together exceed normal household quantities.
(8) We store the contract text. You will receive the order details by email; you can view and print these GTC on this page at any time. You will receive invoices electronically by email.
§ 3 Prices and shipping costs
(1) All prices are final prices and include statutory VAT. Shipping costs are added.
(2) Shipping costs and delivery times can be found on our shipping page and are also shown during checkout.
(3) For deliveries to countries outside the EU, customs duties, taxes and fees may apply which are not included in the total price and are borne by the recipient.
(4) Despite the greatest care, a product may be listed with an incorrect price. If the correct price is higher than the price shown, we will contact you before shipping and ask whether you wish to purchase the product at the correct price.
§ 4 Delivery
(1) Delivery is made to the delivery address you provide. Delivery times can be found on the respective product page and on our shipping page.
(2) We ship pre-ordered items as soon as they have been released and have arrived at our warehouse. For products we open for you in our live streams (LIVE BREAK), the special notes on our shipping page apply.
(3) If we find after your order that a product is not available, we will inform you by email without undue delay. We will refund any payments already made for products that cannot be delivered without undue delay. Your statutory rights remain unaffected.
(4) If your order is shipped in several parcels, you may receive several shipping confirmations. This does not incur any additional shipping costs for you.
(5) If you are a consumer, the risk of accidental loss and accidental deterioration of the goods only passes to you upon handover.
§ 5 Payment
(1) The available payment methods are shown during checkout, including PayPal, Klarna, credit card (Visa, Mastercard, Maestro), Apple Pay, Google Pay and Shop Pay. Further payment methods may be offered depending on the destination country.
(2) When paying via a payment service provider (e.g. PayPal or Klarna), its terms also apply.
(3) For online payment methods, you authorise us to collect the amount due upon completion of the order.
(4) In the event of a chargeback or returned debit for which you are responsible, we charge a flat-rate compensation of €4.99. You are entitled to prove that we incurred no damage or a significantly lower damage.
(5) If you are in default of payment, we reserve the right to claim damages for default.
§ 6 Set-off and right of retention
(1) You are only entitled to set-off if your counterclaim has been legally established or is undisputed by us.
(2) You may only exercise a right of retention insofar as your counterclaim is based on the same contractual relationship.
§ 7 Retention of title
The goods remain our property until full payment has been made.
§ 8 Transport damage
(1) If you receive goods with obvious transport damage, please report this to the delivery service as soon as possible and inform us.
(2) Failure to do so has no effect on your statutory warranty rights. Reporting the damage merely helps us to assert our own claims against the carrier.
§ 9 Warranty
(1) The statutory warranty rights apply.
(2) If the customer is not a consumer, the limitation period for claims for defects is one year from delivery of the goods. This does not apply to claims for damages due to injury to life, body or health or in cases of intent or gross negligence.
§ 10 Liability
(1) We are liable without limitation for damages resulting from injury to life, body or health and for damages based on an intentional or grossly negligent breach of duty by us, our legal representatives or vicarious agents.
(2) In the case of simple negligence, we are only liable for the breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract.
(3) The provisions of the German Product Liability Act remain unaffected.
(4) Insofar as our liability is excluded or limited, this also applies to the personal liability of our employees, representatives and vicarious agents.
§ 11 Right of withdrawal
Consumers have a statutory right of withdrawal. You can find all details in our cancellation policy. You can also declare your withdrawal online using the button “Withdraw from contract”.
§ 12 Data protection
Information on the processing of your personal data and the use of cookies can be found in our privacy policy.
§ 13 Applicable law and place of jurisdiction
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection granted by the mandatory provisions of the law of the state in which you have your habitual residence.
(2) If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is our registered office.
§ 14 Final provisions
(1) If we do not exercise a right under these GTC, this does not constitute a waiver of that right.
(2) Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall replace the invalid provision.
